1. Acceptance of Terms

Welcome to Platform CheckinView.com! By accessing or using this CheckinView.com, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Platform.

These Terms of Use are a binding legal agreement between you and CheckinView.com that governs your use of this Platform, its offerings, and services. Please read these Terms of Use carefully before using the Platform.

2. Description of Service

CheckinView.com (collectively “CheckinView”, “Platform”, “We”, “Us” or “Service”) offers an online platform that enables you to share videos, photos, and reviews of hotels (collectively, “Review”) as well as search for perks and hotels around the world. Hoteliers that offer accommodations, discounts, benefits, and services (collectively, “Hotel”) and our third parties such as advertisers, co-branders, affiliates, technology providers, or other business partners (collectively “Third Party”) can publish their offers, services, and events on our Platform.

In the sections below, we have listed the important legal terms that apply to anyone who visits or uses our Platform and Services.

3. Your Obligations

You confirm that you are 18 years old or over and can make legally binding agreements. You understand that you are responsible for all uses of our Platform, as well as ensuring that all persons who access our Platform through your internet connection are aware of these Terms of Use and comply with them.

4. Business Use

If you are using our Services on behalf of a business, you and that business confirm that they will accept these Terms of Use. You and the business you represent will hold harmless and indemnify CheckinView, the Hotels, our Third Parties, and employees from any claim, suit, or action arising from or related to the use of our Services or violation of these Terms of Use, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and fees.

5. User Content

Submitted Reviews may contain videos, photos and texts. CheckinView values honest and authentic Reviews, so please do not submit videos and photos with overlays such as filters, logos, stickers, promotional materials, or identifiable people who have not consented to have their likeness displayed on our Platform, in print, or otherwise publicly.

You should only submit Reviews that are relevant and appropriate to our Platform. The Review must not contain objectionable content, including but not limited to inappropriate background conversation, nudity, violence, obscenities, profanity, hate speech, offensive content, promotion of illegal conduct, or other people’s personal information such as names, phone numbers, or email addresses that can be used to identify a specific person. Moreover, the Reviews may not defame, abuse, harass, or violate the legal rights of others. Please keep a friendly tone and refrain from using personal insults, threats, prejudiced comments, or other non-friendly utterances. We reserve the right to disregard Reviews that do not meet the stated requirements and that we consider to be potentially inappropriate or offensive.

In addition, you represent and warrant that your Review is based on honesty and is not misleading.

6. People Featured

By submitting your Review, you guarantee that any people who are clearly identifiable have consented to have their likeness displayed on our Platform, printed, or used in any form of media and marketing activities by CheckinView, the Hotels, and our Third Parties, and that you have full rights to use the Review in this manner and accept full responsibility and risk associated with the uses mentioned.

7. Rights You Grant to Us

CheckinView does not claim any copyright or any kind of ownership rights to the Reviews. In the course of submitting your Review, you may provide personal information and media, which may be used by CheckinView, the Hotels or our Third Parties in connection with our Services and marketing activities, which may be visible to other people. You hereby grant Us, the Hotels, and our Third Parties an unrestricted, royalty-free, non-exclusive, worldwide, and transferable right to use and fully exploit the submitted Review, to copy, modify, crop, reproduce, edit, publish, display, share, distribute, or otherwise use in any manner to promote our services and derivative works thereof in any media formats and through any media channels without any further consent from you and payment of any compensation to you, any person, or legal entities. We reserve the right to use, not use, or discontinue using any Reviews at our sole discretion at any time.

8. Accepting and Rejecting

All Reviews submitted to CheckinView will be assessed by our team for suitability. Reviews that do not meet our mentioned requirements will be deleted from our database, entirely with no copies remaining in our system. We reserve the right to reject and remove any submitted Reviews for any reason, at any time without prior notice.

9. Your Responsibilities and Assumption of Risk

By submitting your Review, in whatever form and through whatever means, you are solely responsible for its content and for any offense, claims, or damages that arise from the content of your Review.

The approval and publication of your Review on our Platform in no way alters or diminishes your responsibility. Nor does it transfer any responsibility of the Review to CheckinView that approves the Review for publication and dissemination.

Under no circumstances will CheckinView be liable in any way for any Reviews, including but not limited to any losses or damages of any kind incurred in connection with the use of or publication of any Reviews submitted, posted, emailed, accessed, transmitted, or otherwise made publicly available.

CheckinView displays Reviews that is the sole responsibility of the entity/person that makes it available on our Platform. There is no reasonable way for us to monitor all submitted Reviews and we are under no obligation to you or other users to monitor, edit, or control the Reviews that you and other users upload or submit to our Platform. This means that we are not responsible for any Reviews and you agree not to make any claims against us on account of the submitted Reviews.

We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. However, this does not imply that we scrutinise all submitted Reviews.

10. Copyright and Ownership

By submitting your Review to CheckinView, you guarantee that you are the legal owner of the submitted Review or have been awarded full and unrestricted rights and permission from the copyright owner to share and utilise the Review for the purposes of our Platform or any other distribution channels including, but not limited to, our Platform, selected Hotel’s or Third Party’s websites or any media channels.

You guarantee and warrant that such use of your Review on our Platform does not violate the rights of any other party, does not result in a breach of contract between you and any other party, and that you are solely responsible and liable if any of your Reviews violates or infringes the intellectual property or privacy rights of any third party. You accept full responsibility for any claims, costs, royalties, or fees to any other party for CheckinView use of your Review.

Reviews that are considered to infringe the copyright or trademarks of other individuals, organizations, or companies will be removed from our Platform. The copyright owner can submit a takedown request. If this is a valid request, your Review will be removed from the Platform.

11. Intellectual Property

Content made available on CheckinView may be protected by copyright, trademark, and the laws of Denmark or other countries. Thus, using our Platform does not grant you the right to use any videos, photos, logos, or intellectual property rights displayed on our Platform. You may not use, copy, modify, prepare derivative works of, distribute, license, sell, publicly display, transmit, transfer, broadcast, or otherwise exploit any content displayed on our Platform except to the extent that we have granted you the right, you are the legal owner of that content, or otherwise permitted by law.

12. Third Party Links

Our Platform may contain links that direct you to Third Party’s website that may offer products and services that you seek. At the time we publish the Third Party’s offers, we have received confirmation from the Third Party that their offers and services are valid. However, we have no control over the Third Partis and we therefore do not warrant or guarantee that their offers are not subject to change or become unavailable. When we direct you to a Third Party’s website and you make a booking or a purchase, you and the Third Party are entering into a contract directly with each other. CheckinView does not form any part of or participate in any contractual relationship between you and the Third Party. We do not act as an agent between you and the Third Party, nor are we responsible for the Third Party’s products, services, or website content. Please see the Third Party’s website for its most up-to-date offers, information, and applicable terms.

If any misinformation or disputes arise from the offers displayed on our Platform, CheckinView shall not be liable in any way for any claims, compensation, costs, royalties, or fees to you or any other party. The handling of the dispute is solely between you and the respective Third Party.

13. Third Party Services

CheckinView may contain links to third-party websites that have different terms and privacy policies.

We have no control over Third Party’s website and are therefore not responsible for any aspect of their services, resources, or website content. If you access any Third Party’s website from CheckinView, you will carry all risks and you agree that CheckinView has no liability arising from your use of or access to any Third Party’s website content or services. We encourage you to take precautions when you leave our Services and to read the terms and privacy policy of the Third Party carefully before your continued use.

14. Google Terms

Some translations on our Platform have been translated for your convenience using translation software powered by Google Translate. “Google disclaims all warranties relating to these translations, expressed or implied, including any warranties of accuracy, reliability, and any implied warranties of merchantability, fitness for a particular purpose, and non-infringement." These translations are provided as a service to our users and are provided "as is" with no warranties whatsoever.

Some areas of our Platform implement Google Maps services, including Google Maps API(s). Your use of Google Maps/Earth is subject to the Google Maps/Google Earth Additional Terms of Service.

15. Your Comments and Feedback

We value hearing from our users and are always interested in learning about new ideas on how we can improve CheckinView. If you choose to send us your comments or feedback through any means, you agree that CheckinView may save your email address and any email correspondences between you and CheckinView. We may also contact you regarding your comments or feedback without any restriction or compensation to you, any person, or legal entities.

By providing your comments or feedback to CheckinView, you agree that it may be used by CheckinView for the following purposes:

(a) To develop and improve CheckinView Services

(b) To contact you with general or personalised notices

(d) To irrevocably assign to CheckinView any right, title, and interests you may have in such comments and feedback

(e) To irrevocably waive all claims relating to any past, present, or future moral rights, legal entity, or person’s rights, or any other similar rights to such comments and feedback.

If you provide us with any comments or feedback relating to the CheckinView Services, such comments and feedback shall be exclusively owned by CheckinView.

16. Disclaimer

We strive to provide the most accurate information on the CheckinView. However, we do not warrant the accuracy, reliability, and suitability of any kind on our Platform. When you use our Services, you assume full responsibility and all risks arising and associated with your use of the Platform. All content on our Platform is provided “As Is” and may include inaccuracies or technical and typographical errors.

We hereby disclaim all representations and warranties, whether express or implied, created by law or otherwise, including, without limitation, any warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We shall in no event be liable for any damages, costs, expenses, or losses of any kind, including, without limitation, direct or indirect damages arising from or in connection with your use of the Platform, regardless of whether CheckinView has been informed of the possibility or likelihood of such liabilities. Furthermore, we shall not be liable for any defamation, falsehoods, misinformation, obscenity, and/or any other unlawful and infringing content you or any other party may encounter.

17. Limitation of Liability

CheckinView is provided on an “As Is” and “As Available” basis with all faults. We do not assume any liabilities for the information or content provided on, posted to, or otherwise made available on our Platform. In no event shall CheckinView, our affiliates, Third Parties, agents, shareholders, employees, or customers be liable to you for any direct, indirect, incidental, or consequential damages whatsoever, including any damages resulting from (1) errors, mistakes, or inaccuracies of any content; (2) the use or publicly display of any content submitted, emailed, or otherwise transmitted to CheckinView; (3) events beyond the reasonable control of CheckinView, including any internet failure, technical errors, non-performance of Third Parties; or (4) loss of use, data, profits, or other tangible and intangible losses, resulting from your use of the Platform.

You acknowledge and agree to these limitations of liability and such agreement will apply even if We have been informed of the possibility of such liabilities.

18. Force Majeure

CheckinView shall in no event be responsible or liable for any delay or failure to perform hereunder arising out of or caused by, directly or indirectly, forces beyond our reasonable control, including, but not limited to, natural disasters, accidents, communications or computer (software and hardware) failures, pandemics, epidemics, war, terrorism, riots, strikes, labour disputes, insurrections, civil disturbances, shortages of labour or materials, fires, floods, storms, explosions, governmental actions, orders of courts, agencies or tribunals, and the like.

19. Changes to Terms

We may modify the Terms of Use at any time, and such modifications shall be effective immediately upon posting of the modified Terms of Use on our Platform. You agree to review the Terms of Use periodically to be aware of such modifications, which become part of your agreement with us if you use our Platform.
